The people at Aussie Speeding Fines are out there trying to make a difference in the world, for the better. They are understandably incensed at the outrageous and unjust speeding fines that are being slung on responsible motorists throughout Australia, via speed cameras and the like. They have researched the law and struck back most effectively.
How do I know this? Because I’ve used their system successfully, to make speeding fines go away!
In February 2009, I received an “infringement notice” in the mail, alleging I had been tracked doing 58kph in a 50kph zone. The shot was taken at 11:30pm at a place where the 60 zone changes back to 50. There was not a car on the road – so it wasn’t about road safety. Don’t let all the advertising fool you! Speed cameras are not about road safety, but revenue raising. The funds collected are not allocated to improving our road conditions, but go towards more advertising to fool the public – and more speed cameras. It is a multi-billion dollar a year business … and it is corrupt.
But I digress ….
I replied to the agency with a letter, objecting to their allegation and requesting proof that the equipment they used to measure my alleged speed was accurately calibrated in accordance with national statute law regarding such items – and that the law which they claimed I had broken was one which had been enacted by Parliament in accordance with the constitution of Australia. There were a few other matters mentioned … but the bottom line was, that if they could not provide such proof, it would be understood that they had no legal right to impose or collect a fine from me.
I received a reply from them, stating that they were satisfied their camera was accurate and that the matter should stand.
Then I sent them a second letter. This was in the form of a legal document, witnessed by a JP and advising that they had defaulted on their responsibility to provide aforementioned proof and that, this being the case, the matter was now closed.
They replied to that letter, again stating that as far as they were concerned, the matter should stand and that if I wished to pursue the matter in court, I could do so by completing and returning THEIR enclosed form.
I ignored their suggestion and sent them one final letter, another legally recognized document – attaching all previous correspondence (you have to keep copies) and advising that as the matter was now closed per previous correspondence, any further attempts to solicit monies or allege unlawful behaviour would be considered unwelcome harrassment.
It is now late July and I have not heard from them since.
I just wanted to share this with anyone who reads, so that you can be assured that the information provided by Aussie Speeding Fines DOES WORK. Speed cameras DO NOT reduce road accidents. Speeding ‘as such’ is not the problem. Statistics clearly indicate that most accidents occur at intersections or on the open road from drivers falling asleep at the wheel. The real problem is speeding for the conditions or driver inattention. The whole system is a rort and only stinging the back-pockets of the public. It is not in the public interest and must be stopped.
